Privacy Policy

The short version. Sparky Solar collects basic contact info, address, and electric-bill details so we can show you what solar would save your home and follow up about it. We don't sell your information. We don't share your phone number or your consent to be contacted with anyone outside the service providers who help us run our business. You can opt out of any communication at any time — including SMS by replying STOP, email by clicking unsubscribe, and phone by telling us "do not call" or contacting us at (805) 723-3349.

1. Who We Are

This Privacy Policy describes how Sparky Solar ("Sparky Solar," "we," "us," or "our") collects, uses, and shares information about you when you visit our website, request a solar savings estimate, communicate with us, or otherwise interact with our services. Sparky Solar is a licensed California solar contractor serving Santa Barbara County and San Luis Obispo County in Pacific Gas & Electric (PG&E) territory.

2. Information We Collect

Information you provide directly

When you submit our solar calculator form or otherwise contact us, we collect:

  • Identifiers and contact info: first and last name, email address, mobile phone number.
  • Property information: street address (or city and ZIP if you decline to share the street address), homeowner status, approximate roof age.
  • Electric bill information: your monthly electric bill amount, and optionally a photo or PDF of your utility bill, which we process to extract billing amount, billing period, and supplier.
  • Communications: the contents of any messages you send us by form, email, SMS, voice call, or chat widget.
  • Consent records: the specific consent choices you made on our form (email follow-up, AI-assisted call), the time of submission, and the consent language shown to you at the time.

Information collected automatically

  • Device and usage data: IP address, browser type, device type, pages viewed, referring URL, and approximate location (city/region) derived from your IP.
  • Session recording and analytics: we use Microsoft Clarity to record anonymous session interactions on our pages (clicks, scrolls, mouse movements) to understand how visitors use the site. Sensitive form fields are masked so the recorded session does not capture the contents of your name, email, phone, address, or bill amount.
  • Advertising pixels: we use the Meta (Facebook/Instagram) pixel to measure ad performance and to build advertising audiences. The pixel may record events such as page views, form starts, form submissions, and appointment bookings.
  • Cookies and similar technologies: small files placed on your device by our website and third-party services. You can control cookies through your browser settings.

Information from third parties

We use Google's Solar API and Geocoding API to retrieve publicly available roof orientation, shading, and solar potential data associated with the address you provide. We do not receive personally identifiable information from these services — we only receive data about the property at the address you submit.

3. How We Use Your Information

We use the information we collect to:

  • Calculate a personalized solar savings estimate for your home and deliver the results to you;
  • Send you the email and (if you consented) the AI-assisted phone call associated with your solar inquiry;
  • Schedule and confirm consultation appointments with our team;
  • Send appointment confirmations and reminders by SMS when you have booked a consultation;
  • Respond to your questions and provide customer support;
  • Improve our website, calculator accuracy, and customer experience;
  • Measure and optimize our advertising;
  • Comply with legal obligations and protect our legal rights.

4. SMS / Text Message Communications

SMS Program Summary

Program name: Sparky Solar Appointment Notifications.

What we send: appointment confirmations and reminders for solar consultations you have booked with us. We do not send recurring marketing or promotional SMS.

Message frequency: recurring as needed — typically 1 to 4 messages per booked appointment (confirmation, 24-hour reminder, and same-day reminder).

Message and data rates: may apply. Carriers are not liable for delayed or undelivered messages.

Opt-out: reply STOP at any time to any text message from us to stop further SMS. Reply HELP for help, or contact us at (805) 723-3349.

How you opt in to SMS

You consent to receive SMS messages from Sparky Solar by booking a consultation through our scheduling page. The booking page displays SMS consent language directly with the booking form, including message types, frequency, opt-out instructions, and rate disclosures. Submitting the booking with your mobile phone number constitutes your opt-in. SMS is used solely for appointment confirmation and reminders related to bookings you have made — we do not use SMS for promotional or marketing communications. You are not required to consent to receive SMS in order to purchase any product or service from Sparky Solar.

What messages you may receive

  • Booking confirmation: sent once after you schedule a consultation, confirming the date, time, and how the appointment will be conducted.
  • Reminders: a 24-hour-prior reminder and, in some cases, a same-day reminder, including the consultation details.
  • One-on-one operational messages: direct communication from our team in response to a question you asked, such as rescheduling or sharing a document.

We do not send recurring marketing or promotional SMS through our SMS program. All marketing communication outside of booked-appointment messaging happens by email, which you can unsubscribe from at any time.

How to stop receiving SMS

You can opt out of SMS at any time using any of the following methods:

  • Reply STOP to any SMS message you receive from us. We will send one final confirmation message and you will not receive further SMS from our program.
  • Reply HELP to any SMS message to receive a help reply with our contact information.
  • Call us at (805) 723-3349 and ask to be removed from SMS.
  • Email us at [email protected] with the subject line "SMS OPT OUT" and the mobile number to remove.

How your mobile number and SMS consent are handled

We do not sell or share your mobile phone number, SMS opt-in, or the contents of any SMS communication with any third party for their own marketing purposes. We do not share this information with affiliates for marketing purposes. The only parties that receive your mobile phone number or SMS consent are the service providers we use to operate our business (such as the messaging platform that delivers SMS on our behalf), and only to the extent necessary for them to provide that service to us. These providers are contractually restricted from using your information for any purpose other than providing services to Sparky Solar. See Section 7 for the list of service providers.

5. AI-Assisted and Prerecorded Voice Calls

If you check the "Give me one results call" box on our form, you are agreeing that Sparky Solar may place one outbound phone call to the number you provided to walk you through your solar results and related options. This call may use artificial, prerecorded, or AI-generated voice technology. You are not required to consent to this call in order to purchase any product or service from Sparky Solar.

You may opt out of further AI-assisted or prerecorded calls at any time by saying "do not call" during the call, by contacting us at (805) 723-3349, or by emailing [email protected]. Calls may be recorded for quality assurance and training purposes. A transcript of the call may be saved to your contact record.

6. Email Communications

If you check the "Email me my results" box on our form, you consent to receive your savings results and related follow-up emails from Sparky Solar. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us. Operational emails (such as appointment confirmations and responses to your questions) are not subject to marketing unsubscribe — to stop those, contact us directly.

7. How We Share Your Information

We share information only as described below. We do not sell your personal information, and we do not share your information with third parties for their own marketing or advertising purposes.

Service providers

We use the following categories of service providers to operate our business. These providers process your information only on our behalf and only to the extent necessary to provide services to us:

  • CRM, email, and SMS delivery: GoHighLevel (LeadConnector) and Twilio. Used to store contact records, send transactional and marketing emails, deliver SMS messages, and manage scheduling.
  • Calling and voice AI: Retell AI, for AI-assisted voice calls (if you consented).
  • Workflow automation: n8n (self-hosted), for connecting our systems and processing form submissions.
  • File storage: Cloudflare R2, for storing utility-bill files you upload.
  • Edge proxy: Cloudflare Workers, for routing form submissions and protecting against abuse.
  • Solar and address data: Google (Solar API, Geocoding API, Document AI), used to retrieve roof-level solar potential data and to extract bill amounts from uploaded utility bills.
  • PDF generation: PDFMonkey, for generating personalized savings report PDFs.
  • AI text generation: Anthropic (Claude), for generating internal pre-call briefing notes for our team.
  • Analytics: Microsoft Clarity, for anonymous session recording with sensitive fields masked.
  • Advertising: Meta Platforms (Facebook/Instagram), for measuring advertising performance via the Meta pixel.

Legal and safety

We may disclose information when required by law, subpoena, or other legal process; to enforce our agreements; to protect the rights, property, or safety of Sparky Solar, our customers, or others; or in connection with an actual or proposed business transaction such as a merger or sale.

With your direction

We may share information with other parties at your specific direction — for example, if you ask us to coordinate with your tax advisor or roofer.

What we do not do

We do not sell your personal information. We do not rent, lease, or trade your information. We do not share your phone number, SMS consent, or email address with any unaffiliated third party for that party's own marketing purposes.

8. Cookies and Tracking Technologies

Our website uses cookies, pixels, and similar technologies to operate the site, remember your preferences, measure traffic and conversions, and serve relevant advertising. You can control cookies through your browser settings. Blocking some cookies may affect how the site functions for you.

We honor the Global Privacy Control (GPC) browser signal as a valid opt-out of sale or sharing of personal information for California residents.

9. Data Retention

We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Lead and customer records are typically retained for as long as you are an active prospect or customer, and for a reasonable period afterward to maintain consent and communication records as required by law. SMS consent records and opt-out requests are retained for the period required by applicable telecommunications regulations. You may request deletion at any time, subject to legal exceptions, as described in Section 11.

10. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, disclosure, alteration, and destruction. No method of transmission over the internet or method of electronic storage is fully secure, so we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and the appropriate authorities as required by applicable law.

11. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you the following rights:

  • Right to know: request the categories of personal information we have collected, the sources, the purposes, and the categories of third parties with whom we have shared it.
  • Right to access: request a copy of the specific pieces of personal information we have about you.
  • Right to correct: request correction of inaccurate personal information we hold about you.
  • Right to delete: request deletion of personal information we have collected about you, subject to legal exceptions.
  • Right to opt out of sale or sharing: we do not sell personal information, and we do not share personal information for cross-context behavioral advertising in a way that meets the CPRA's definition of "sharing." If this practice changes, we will update this Policy and provide opt-out mechanisms as required.
  • Right to limit use of sensitive personal information: we do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA without further notice.
  • Right to non-discrimination: we will not discriminate against you for exercising any of these rights.

To exercise any of these rights, contact us using the details in Section 14 with the subject line "California Privacy Request." We will verify your identity before responding, typically by confirming information you previously provided to us. We will respond within the timeframes required by California law. You may designate an authorized agent to make a request on your behalf, subject to verification.

12. Children's Privacy

Our services are intended for adults who own residential property. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us at [email protected] and we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice — for example, by posting a prominent notice on our website or, where appropriate, by emailing you. We encourage you to review this Policy periodically.
